Winshester 9422 firing problems

Friday I bought a Winchester 9422 NIB from the local sporting goods store. It’s a Legacy but is not the Tribute. The gun will not fire off a round and leaves very very slight marks on the rim of a cartridge. I noticed the frame and stock had a little slack and every now and then I could get a round to go off when I slightly pushed up or down on the stock. I pushed the stock down to where it would fire then tightened the take down screw until the stock to frame fit was snug and would no longer move. No luck though… after tightening the take down screw to where it would no longer slip the thing will not fire.

Do you all have any ideas of what it will take to fix this gun? If its something I can do at home I’d rather do that instead of send the gun off for a while.

My guess is that the stock wood is binding on the mainspring or the hammer.  
I'd remove the stock to see if there is any rubbing going on.
