Looks like a smooth bore to me.  No rear sight and a bead front.  I wonder how many of those things exist?

as mentioned above, due to sighting system (ie bead front and no rear) I call it a shotgun.

Rifling makes a long gun a rifle. 

To the feds its a "smoothbore" legally, which smoothbores are typically called shotguns.  But a smoothbore that is meant to shoot single projectiles like a rifle would shoot is often called a musket.  If it has a shorter barrel than the musket version it is called a musketoon.  But in todays world they are just called smoothbore rifles.

It might be a shotgun but not sure a game warden would think so with it stamped 45-70.

might be a shot gun. Stevens made thee crackshot one the no.26 with  rifled bore and the 26 1/2 was a smooth bore for rat shot.

I believe if it fires the 45-70 shot shell, it is a shotgun. If it were to fire the 45-70 rifle cartridge, I believe it would qualify as a WSD (Weapon of Self Destruction).

Definitely shotgun.  There used to be a 45-70 shot shell.  Some say you can shoot the 2 1/2".410 shells in it but I have no personal experience trying that.  Maybe I'll give it a try in my 45-70 handi. 

These are great actions to convert to low pressure handgun rounds.  I love this project:

It could be a line throwing gun.  I know some of those were made in .45-70....

I saw one like that in 44-40 at a gun store one time. It was a smoothbore and said 44 shotshell on the side.
