photo enforcement ticket!!!

how many of you have got one of these things in the mail. i just don't think they are right.

Were you speeding? I work 70 miles from my house and I also speed sometimes to get to work on time. If I get get caught I deserve it because I know I was speeding. I try not to go over 10 mph over the posted speed limit though. Other wise you really risk high fines and posibably court. So if you were speeding yes you deserve your ticket. :o ;D ;) Dale

I have always wondered, if they had your vehicle speeding on  camera, but didn't have a clear picture of your face coul they convict you in court? Be nice to hear a legal opinon on this one. I am guessing that they have written the speeding laws to make it a crime for your vehicle to be driven over the speed limit, whether you are the driver or not.
99% of all Lawyers give the other 1% a bad name. What I find hilarious about this is they are such an arrogant bunch, that they all think they are in the 1%.

I don't follow ??? Were you or the cop driving the van? If you were driving the van and were caught speeding. Does it really matter weather you were driving a van or a Corvette? Dale

I think it is a big joke.  My wife only has one eye, and was having problems seeing with the other, she went to the mail box one day and picked up the mail, one had our address, but a different name on it.  She didn't notice the name, just the address so she opened it. The letter contained a letter demanding payment for a traffic photo ticket for a man in Houston, TX.  I enclosed a note and sent it back to the person that sent it advising them they had the wrong address.  Over the next few months we received at least 12 more letters.  Since the license number of the vehicle was on the letter,  I noticed that it was only one number from mine, I called a friend who is a DPS officer and told him about the letters, gave him the license number and he looked up the person’s correct address,  I annotated the next letter to forward to that address.  I continued to get letters from them, I would send them back marked, “Not at this address”, they kept coming. I called the company that does the collection for Houston, they are out of Arizona, I got a female that was dumb as a brick, she accused me of being the person and said she was sending a cop out to arrest me, I told her to bring it on then hung up.  Finally, I called the DA’s office for the City of Houston, I haven’t received any more letters.

I’m thinking, this poor guy is going to get his butt reamed because he did not respond to the dozens of letters that were sent to the wrong address.  I think there are only two-three companies that do the traffic photo thing by contract for several cities, I wonder if all have the same problems.

Sometimews they park a van with an automated photo enforcement system in it on the side of the road and leave it there.

Around here it's usually in construction zones and that means $375.00 minimum.

This guy was driving down the street and passed a traffic camera, as he goes by the flash gets his attention, he thinks to himself, “I was speeding, why did it take my picture.”  He immediately makes a right turn and goes around the block and drives past again going much slower than the first time, there is another flash, “he thinks, “Darn, I know I was only doing 25 MPH, why did it take my picture?”  He goes around the block again doing 15 MPH, same thing, so makes the block once more and passes the camera at 5MPH, another flash!  He thinks, “that darn thing must be broke so he goes on his way.  Several days later a letter comes with four tickets for not wearing his seat belt. ::)

I have gotten them at the last trucking company I worked for. Had to match the drivers up with the truck. Made the comment that when  you faced your accuser in court, how would they question the camera? Seems the officer who regulates the camera is the actual accuser.

Those things are just a way to make money.  They do little if anything to slow down traffic.  There is one outside of my base here in Germany.  It is the only local one I know of that actually causes traffic to slow down to avoid a ticket.  Down towards Munich there is a long stretch of highway that has several sets of the things and traffic there slows down too.  In general, they hide portable units just inside of the city limits of small towns.  Traffic doesn't slow down because they aren't there all the time.  So the cameras just set there and flash all day and the town rakes in the cash for a week or so.  It wouldn't bother me so much if they were owned by the cops/city but they aren't.  They are owned by a company that contracts to the local government and then they are profiting off of every ticket issued.  I just don't think private companies should profit from traffic enforcement like that.

There is a small city just south of us, that uses those. Not sure if it's a state law, or local ordinance, but there has to be a police officer sitting in the van. Something about a live certified officer has to actually see the infraction, sign the readout. I just wonder why they don't just set a regular patrol car out?
The one thing this city had to do, was change some of their speed signs. Seems here in the state of Ohio, before a city or municipality can just change a speed on a street, it has to be registered with the state, and ok'ed. Well, seems this city was just picking and choosing what streets had what speed limits, and handing out tickets. Somebody took them to court, or double checked with the state, and turned them in. They didn't have to pay back any of the money collected from the speed traps, but a few of the streets that suddenly went from 35-40mph, down to 25, all of a sudden, went back up to there original speed.
And no, I never got a ticket that way, but the wife got one a few years ago. I keep telling her she has a lead foot. She was lucky, only $96 fine at the time. gypsyman

It's all about revenue, baby! They are doing that for the money. It has nothing to do with public safety or any legitimate police activity. It is yet another example of why the police are so widely despised. In fact the cops are just doing their jobs, it's the politicians that are doing it to you.

Well--coming from a guy who just paid a ticket---I got what I deserved. Fess up, when you drive you agree too obide by the law. Any other arguement is just refusing to admit the truth.

They had a speed trap with a camera set up on a road to work, so on the way home, the guy I ride with dropped me off at the camera, went down the road a ways, and came back doing 85, while I was "mooning" the camera...the police now have a picture of my rear doing 85 in a 55. ;D

the cameras are being installed everywhere and the good part is they don't get pensions like the cops do so we all save money on taxes to pay pensions so that will allow us to have money to pay more fines, see how the government thinks.

I want to know if the law is written to punish the owner of a vehicle? Atlaw, Dukk here is your time to shine can a person be convicted of speeding if their is no clear picture of the drivers face? I would think a jury would acquit if faced with no proof the owner was the driver. Or is the law written to make the owner liable. Ikd really like to hear a legal take on this subject.

The city of Anchorage started this a few years back.  The first day they sent out around 800 tickets.  The second day they sent out over 1100 tickets.  I got two, one each day.  We all refused to pay, and showed up at traffic court the same day.  Now this is a court that sees an average of 5 to 10 people a day.  We not only filled up the court room, but the hallway, the Lobby, and had a line standing out on the sidewalk waiting to get in.  The judge threw all the tickets out and refused to accept any more. 

The city of Anchorage canceled the contract and paid a hefty fine to the contractor for canceling.

well we don't have to pay the machine to sit at the doungh shop on break , Or misread his equipment . Would seem the machine is more cost effective ( less burden on tax payers ) and less personal ( like he just dosen't like red sports cars etc. ) . OBEY the law and don't worry , your vehicle ain't a time machine , so leave in time to get where you need to be with out speeding ! at least that's what the judges have told me on several occasions .

What I can tell you about these systems.  When I was in Korea they had them on the highway.  I got my picture taken doing 65 hauling munitions on a 40'.  I didn't have to pay any fine....but my face and name tag were clear as day in the picture.

The Chief of Police and Mayor here instigated the installation of red light cameras last year.   Smart aleck neighbor kid got a photo ticket a few months back. He just paid it then got to feeling pissed off so he downloaded a program he found on the net, made up some photo quality prints of our police chief's and mayors license plates, taped 'em onto his own car and ran some stop lights in a neighboring town that funds itself with traffic fines.   Mayor and Chief are still fighting with it five months on.   

It is to laugh.  This bullcrap has nothing to do with safety and everything to do with money.

Speeding tickets are nothing more than extortion sponsored by the government using police for muscle.
It is the same with any so called crime or offense where no person or property is damaged or stolen, and no expense is incurred as a result of the act. They should repeal all such laws.

 So a DWI that does not involve property damage or injury to a person is ok? Or shooting deer out of season is ok too? How about everyone obey the rules and there is no fine!!! If someone has to speed to get somewhere, outside of an actual medical emergency, then it is simply a personal time management problem or simple contempt for the law.

I have no problem with the police giving speeding tickets, I would actally encourage them to patrol and give many many more. I drive alot for my job and see the death and destruction caused by speeders. But what I would like to know is how a person can be held criminally responsible if someone else commits the crime with their vehicle.
