Problem with my Marlin 336CS in 35 Remington

I've had a problem with my Marlin 336CS in 35 Remington since I purchased it. Maybe one of you fine folks can help me out. If I put 3 rounds in the tube, chamber one of them, and fire a shot, the action locks up because the 2nd and 3rd round prevent the lever from coming down. That is to say that instead of just one round being on the lever to raise it up for chambering, the 3rd round is far enough out of the tube preventing the lever from moving. It does this with all ammo, not just my reloads. I have tried using heavier bullets with a longer A.O.L. but that didn't help. I've been living with the problem by never putting in more than two rounds. I sure do enjoy this rifle. It loves golf balls at 75 yards! Thanks in advance for any help you can provide!

You don't say if this happens if you don't fire it but I'll assume it does.   I'm not sure exactly what is happening but it appear the magazine cut off is not working properly. ( duh.. )  On my Marlin, when the action is cycled, a round is lifted and the bolt chambers the round.  As I fully close the action, the next round in the tube is released and can be seen with the base of the cartridge against the loading gate.   Moving the lever down extracts the round from the chamber and allows the next round all the way on to the loading ramp.  If this is where the third round jams the action then it appears the cut off is not getting into postion quickly enough or perhaps is broken.   It could also be that the round is not released as you close the action and the loading ramp gets in the way.  Either way I would contact Marlin at :

Send it back to Marlin RIGHT NOW!

There is a latch,protrusion, stop, whatever you want to call it on the right side of the frame just forward of the magazine tube. This is NOt depressed until the lever is worked. I am suspect that the spring in it is null and void.  Not a big yank to get it fixed.

In my vast experience with Marlin, you'll have your rifle back in less than two weeks fixed better than new. Give em the chance to fix it.
