Scott Springston just posted some info regarding the Paulson boys. It reminded me that I have seen them on several occasions fire exploding shells from both mortar and cannon.

How the heck do they get away with it????????

I was just at a big shoot and took several cannons out. Some on lookers including several Peace Officers asked if I could fire some exploding shells. I said "You guys walk over and talk to the ATF folks and if they give a Green Light, in writing of course, I'll do it". The answer was what I expected, NO WAY JOSE, don't even think about it, "you might get more than a slap on the hand".

My understanding is each round must be registered, are the Paulsons doing that??????????

There are several categories of things that are and are not regulated.  Firearms and Destructive devices are two legally defined terms that BATFE enforces the pertenant laws and regulations.

And then there are fireworks and signalling devices that are not either of the above and fall into other areas of the law.  I am not an expert by any means, so it is a matter of reading the law and determining what is legal or not in federal, state and local law.

Getting it in writing is certainly the best approach.

This is the US Code regarding Destructive Devices:

Release date: 2005-08-31
TITLE 26  > Subtitle E > CHAPTER 53  > Subchapter B > PART 1 > § 5845
Definitions

(f) Destructive device

The term “destructive device” means
(1) any explosive, incendiary, or poison gas
(A) bomb,
(B) grenade,
(C) rocket having a propellent charge of more than four ounces,
(D) missile having an explosive or incendiary charge of more than one-quarter ounce,
(E) mine, or
(F) similar device;


An individual CAN own a Destructive Device (a 40mm M79 HE round for example) but a Form 4 has to be approved and a $200 transfer tax paid for EACH round. If it's actually fired, there's even MORE paperwork required to account for it.

I may be wrong but I would certainly think that explosive cannon and mortar shells would fall under either A or B.

It would be extremely interesting to know what was actually being fired and how it was done so as not to incur the wrath of the ATF guys.

Just guessing but the Paulson's kept their 13" mortar on a military base for a while and probably did most of its firing there.  I am guessing that the ATF generally stays off military reservations or the explosive shell was nominally the property of the military.
