Title theft.
« on: May 14, 2022, 05:22:51 AM »
I’ve been reading up on this its some scary stuff. All it takes is one single page and the ok from the county clerk. This should not be happening. Folks have been loosing their homes. But of course congress isn't going to do anything about it.

Something doesn't "smell right", with these claims.  I would hope that would require some sort of a verifiable signature etc.

Are homes with mortgages, more vulnerable to this scam ?

I haven't read about homes with mortgages, scammers go more for homes that are paid off. I don't think they want to assume the debt. Which the title company isn't going to allow it. They legally hold the title.

Another problem is internet marriages, two people who hardly know each other. But the wife still gets the benefit of doubt in these cases. I was in court once on a different topic, and had to hear those cases before me. That judge had gotten tired of hearing this and wasn't being very tolerant.

The title company does NOT legally hold the title.  Title is held by the owner, subject to any mortgage or other liens.  It takes a recorded notarized deed to change the status of title.  So, to pull off that scam, you would have to forge the owner's signature and then find a notary public willing to attest to it.

Shucks! I was hoping fully paid off real estate provides some kind of protection.

Still can't figure how some crook can take my property without some kind of relief !

No crimes are adequately punished
anymore. Shouldn't be any television
and workout equipment and dvd players.
Shovels and hoes and agriculture/gardening
tools and equipment, and equipment
for laundry and basic cleaning supplies.
Wake up call, food, go to work until
noontime, chow/latrine break, back to
work until supper, hygiene time, bedtime.
Technical training for those that work
at it and maintain a satisfactory level
of progress
The rehabilitation theory relating to
prison ( in this region) is a ship that
sailed many years ago. I just got
through seeing a multiple offender
felon across the way that started
back on dope and theft as soon as
he was last released. He's made
at least one more welfare baby
since he's been out this last time

Violent crime or not, jail needs to
be serious enough to make someone
think twice about their choices
18 MINUTES.  . . . . . .

You can't sell what you don't own (real property anyway) - so NO ONE can take or sell your home without your acceptance (assuming you don't owe a mortgage, or loan).  If someone "sells" your home who doesn't own it they TRANSFER the rights they HAVE; which is NOTHING.  The fraudulent buyer is the one left holding the bag.  There is a trail of "deeds' at the county records office these are easily reviewed to establish true ownership.  That is what a title company does before they insure valid title.

In some cases they have been able to get away with it by filing a quick claim deed. Especially if some single guy with a home marries one these scammers . Everything changes then. Even If you two are deemed as common law.

A "quitclaim" deed only transfers what you have.  If you have no title you convey no title.  And, if you marry a "scammer" and put title in her name, that's not a fraud, since the marriage was real.  Anything done after that could be a fraud, but not by some stranger, but rather your new wife.
