What other case are you refering to? This is the case everyone has been talking about and there is a thread here about it.
It's an interesting case, and I like the result, but I think more is being made of it than there should be:
1) There was no significant written opinion on the case by the Second Circuit. This idea that it is, "Sotomayor's ruling" is somewhat misleading...
2) There is SCOTUS precedent that it appears the Second Ciruit followed. It's not their job to ignore the previous rulings on similar issues... based on my understanding of the case law, I think they decided it the only way they could. Only the SCOTUS can change the course of precedents.
