Dawn Welsh of Hillsboro, MO Arrested for Trespassing in Her Own Home After Supposed Mortgage Scam

Dawn Welsh thought her house was paid off. She received paperwork from her bank showing it was paid off, but through a series of her mortgage being bought and sold, Wachovia Bank was the final owner of the mortgage and claimed Welsh was still owed on her home despite papers showing otherwise.

Today, Hillsboro, Missouri police came onto her property and broke her door down to remove her from her property near St. Louis. They used a battering ram to enter her home, despite her showing evidence in the past that she owned the property. She had gone to court previously and showed a judge the mortgage was paid in full, and it is a record of the court. However, these are desperate times for Wachovia who continued to threaten the 54-year-old woman.

These paperwork problems aren't uncommon. In fact many people wind up in court after they are told they owe more money on their homes after a series of mortgages being pushed back and forth through the mortgage process.

Wachovia Mortgage took over the mortgage and said they weren't going to honor the paperwork from the previous mortgage and continued to harass this woman. So we have a woman with the proper papers showing her house is paid off with the police and the courts ignoring the paperwork according to the story.

I am in the process of finding the court records they speak of to verify the story.

It doesn't seem reasonable that the cops used such force in a case like this. I distrust the story on that account.

Wachovia acquired deed to the property on 10/21/2008 according to the Jefferson County Register of Deeds.

Wachovia is listed as the current owner of #3 Ed Mar Terrace.

Two real estate sites list the property as "for sale, undergoing final foreclosure"

in that it sounds like when Wachovia purchased the loan from the original mortgagor, that they were not listed as the new lien holder.

So according to the original mortgagor, Ms. Welsh has no outstanding debt on the house as far as they are concerned, because Wachovia paid off their interest to assume control of the mortgage.

I noticed that no one really says she "owns the house" just that when the original mortgagor indicated that they showed her debt paid on their end, there was no other lienholder of record.

Well if they are there to put you out of the house and you refuse to leave then they use what ever force they see fit.

Now I am still unsure as to the whole truth to the story but I am thinking that someone is trying to use some questionable practices to get a free house... Not sure yet as I still do not have all the facts but I am watching this close to see if it is true or not.

 Wachovias favor, may take a few days/weeks to find it

I would like to see the dates when the orignal lean holder marked it paid in full and when the morgage was sold/taken over by Wachovia.
If it was marked paid before the date Wachovia took over then she is in the clear.
She will still have to prove it in court.
She shouldn't have to but you know they won't give in with out a fight.

I once had a creditor send me the free and clear title to a truck that I had refinanced instead of the new lien holder. I'll be that this is the same thing, only the woman is taking advantage.  BTW, it doesn't say she has the title, it says that she has a letter from the creditor, which is worth the paper it's written on without the cleared title or origional loan promissory note stamped PIF.

her against BIG CORP who you think will win this fight!!! I pray it goes her way but will not be surprised if they keep her out. Thats what wrong with this world BIG CORP!!!! I hope they all go under ( sorry if i make anyone mad but i've had it with them) Support you local mom and pop places. Someone long ago told me " you can't beat the machine" Dang if he wasn't right. BIG CORP get all this money from the government but going  kick some lady out of the house she paid for!!!!  best thing she can do is get the locals behind her news media ( news people need to do something good for a change).
